A successful claim requires strong and credible evidence. Simply stating that your back hurts is not enough. You need to provide well-documented evidence that clearly links your condition to the service you received.

A Clear Medical Diagnosis

The VA requires a current diagnosis of back conditions. Some common back injuries related to service include bulging discs, sacroiliac joint dysfunction, arthritis, and spinal fractures. A formal diagnosis by a medical professional is essential.

A Nexus Letter

This is crucial evidence from a medical professional, who provides an opinion linking your back condition to your military service. The nexus letter strongly suggests that your current disability is likely related to your service (at least 50% probability). This standard is based on the duty of the VA to assist, but ultimately the burden of proof lies with you as a veteran.

In-Service Event Documentation

Any record of an injury or complaint about back pain while on duty is invaluable. This includes medical records, personal statements, and statements from other service members who were present at the time of the incident and can testify to the pain and limitations experienced while serving.

Understanding the VA Disability Rating for Back Injuries

Once the service connection has been established, the VA will assign you a disability rating between 0% and 100%. This rating is based on the VA Schedule for Rating Disabilities and determines your monthly compensation.

For back conditions, the rating is often determined by your range of motion, specifically flexion and extension. The more limited your movement and the more painful it is, the higher the potential rating you may receive.
