The PACT Act law passed in 2022 which significantly expanded health benefits and coverage to veterans who were exposed to certain chemicals while serving. As of March 5, 2024, this law was expanded to help provide VA health care and benefits for veterans that may have been exposed to burn pits, Agent Orange, or any other toxic fumes or substances. This law will help expand VA health care to generations of veterans and their survivors ensuring they receive the benefits that were earned.
The PACT Act: Expanded Healthcare for Veterans Exposed to Toxins
The PACT Act greatly expanded the number of health conditions that the VA has determined are presumptive conditions related to burn pits. Certain locations have also been deemed presumptive locations, meaning that if you have a presumptive condition and were serviced there it is assumed that it caused you harm.
Due to the variety of waste that was found in burn pits on military installations they have expanded on the possible exposure of toxins to sulfur, hexavalent chromium, pollutants and other airborne hazards. Burn pits were used to dispose of numerous things, including human waste.
Who is Eligible for Expanded VA Healthcare Under the PACT Act?
While it's clear the service member affected by the possible exposure to toxins is entitled to healthcare and other benefits, the survivors could also be entitled to benefits under the PACT Act if their loved one died from a service-connected disability.
Eligible survivors include a surviving spouse, dependent child, or parent of the decedent. When filing a survivors claim, it can be confusing and difficult without legal assistance. - Mental Health Services: Counseling, therapy, and treatment for conditions like PTSD, depression, anxiety, and substance abuse.
- Medical Transportation: Travel benefits to help veterans access VA healthcare services.
- Caregiver Support: Programs and services for caregivers of veterans, including respite care and education.

How to Apply for Expanded VA Healthcare Benefits
In order to apply for expanded VA healthcare benefits you will need Social Security Numbers for you, your spouse, and all qualified dependents, military discharge papers, the gross household income, and your deductible expenses for the past year. These include certain health care and education costs.
- Apply online with the VA or apply by phone by calling 877-222-8387 to get help with your application. They are open Monday through Friday, 8:00 a.m. to 8:00 p.m. ET.
- Apply by mail by filling out a VA Form 10-10EZ. You or someone acting as your power of attorney must sign and date the form. It’s important to note that if using a power of attorney, you will need to submit a copy of the Power of Attorney form along with your application.
- Apply in person by filling out VA Form 10-10EZ and following the instructions above and taking the VA form 10-10EZ to your nearest VA medical center or clinic.
- Apply with the help of a trained professional. You can work with an accredited attorney, claims agent, or Veterans Service Organization (VSO) representative to get help applying for health care benefits.
